Application Drafting and Amendment

You’ll need a patent application for your initial filing in the United States. It’s possible to do it yourself, but just because you can doesn’t mean you should. We learned that lesson when we tried to cut our own hair during COVID.

Most companies and individuals rely on specialized intellectual property law firms to draft their patent applications. A ridiculous number of variables come into play with patent drafting, so the range of costs is significant. A giant corporation will pay a lot less than Joe the inventor. Life’s not fair, deal with it. 

If you are entering the United States via PCT, you probably already have an application, but some amendments are likely needed for the claims or specification. You will want an IP firm to handle this, but the costs are substantially less than for a full application.

Average IP law firm fees. Highly variable depending on application complexity, the purchasing power of the IP owner, and the size of the down payment your attorney needs for his new Mercedes. 
The fees are dependent on what type of protection you are pursuing, it is unlikely that you would pay both fees. 

Application Filing

The Basics

Now that you have your application (or your amendment is ready for PCT nationalization), the fun and the fees really get started. We’ll start with a basic filing and then move to PCT and more complicated scenarios. 

The United States has a tiered set of fees based on the size of the IP owner. Micro Entities pay the lowest fees, followed by Small Entities, and Large Entities pay full price. More details on these discounts can be found here.

When filing in the United States, you can file a provisional or regular utility application. We aren’t here to teach you about IP, so check out the USPTO  to learn about the differences and talk to your patent attorney. If you file a provisional application, you will have 12 months to file a regular application (and incur the additional costs). 

Whether you file a provisional or a utility model application, you’ll pay fees for your law firm to prepare the paperwork and file the application. Fees will also be paid to the USPTO to accept the application and conduct a search and examination of your application. 

You’re probably thinking, “This doesn’t look that complicated.” Hold that thought; there’s more to come. To discourage large applications (or to make more money), the USPTO has several additional fees that we cover below.

Additional Application Costs

There are several additional costs that come into play as your application gets larger and more complicated. These fees all get paid to the USPTO and are added to and included in your filing fee.  As with the fees above, smaller organizations receive a discount.
