PATENT TERM EXTENSION REQUESTS GOING ALL ELECTRONIC
Effective May 1, 2023, all United States patent term extension requests (PTEs) will be filed via the USPTO patent electronic filing system (Patent Center or EFS-Web).
Prior to the pandemic, PTEs were required to be filed via paper, but during the pandemic, the USPTO allowed for the electronic filing of PTEs.
The change proved popular and supported the PTO’s goals of improving efficiency, so electronic filing will now be mandatory. A link to the USPTO’s final rule is here: https://bit.ly/4lZ2zqd
NEW TRADEMARK LAW COMING TO BERMUDA
A new trademark law has been drafted to modernize the current law, which was enacted almost 50 years ago. The new law is modeled on UK’s trademark law and appears intended to make Bermuda a more attractive business destination through the Paris Convention and the Madrid Protocol.
Among the proposed amendments is the accession to the Madrid Protocol to allow international registrations. Furthermore, the renewal periods for trademark registrations will be reduced from 14 to 10 years. In addition, the current Register divided into Parts A and B will likely be merged into a single register.
We’ll keep you updated as things evolve.
ISRAEL MADRID FEE INCREASE
Effective March 26, 2023, the amounts of the individual fee payable in respect of Israel will change. Those amounts will be:
472 Swiss francs for one class of goods or services and 355 Swiss francs for each additional class, when designating Israel in an international application
841 Swiss francs for one class of goods or services and 709 Swiss francs for each additional class, when renewing an international registration in which Israel has been designated.
