Here Come the Fall IP Fee Updates!
Summer is over, the PTOs are back in action, and the fee updates are starting to roll in. In October, get ready for some substantial Australian IP Fee updates and a minor update to Indonesian Madrid fees.
This is just the beginning, its looking like November is going to be a busy month for IP fee updates.
Australian IP Fee Updates
On October 1st, Australia is increasing fees for patents, trademarks and designs. Here’s a link to their site with all of the details Australian IP Fee updates
There are about seven pages of fee updates, so we aren’t going to cover every update here, but the important highlights are below.
Patent Changes
- The transmittal fee for PCT applications has been eliminated.
- Provisional patent application fees are decreasing from 110 AUD to 100 AUD.
- Innovation patent application fees are increasing from 180 AUD to 200 AUD.
- Standard patent application fees are increasing from 370 AUD to 400 AUD.
- The fee for requesting examination when AUS is the ISA is increasing from 300 AUD to 350 AUD.
- The fee for requesting examination when AUS is not the ISA is increasing from 490 AUD to 550 AUD.
- There are new excess claims fees for the examination process:
- 21 to 30 claims is 125 AUD per claim
- 30+ claims is 250 AUD
- Excess claims fees for Acceptance have been eliminated
- Maintenance fees have increased, examples below:
- The 6th-anniversary fee is increasing from 335 AUD to 345 AUD
- The 10th-anniversary fee is increasing from 490 AUD to 540 AUD
- The 15th-anniversary fee is increasing from 1280 AUD to 1385 AUD
- The 19th-anniversary fee is increasing from 2650 AUD to 2815

Design Changes
- Applications for the first design are decreasing from 250 AUD to 200 AUD
- Applications for additional designs are decreasing from 200 AUD to 150 AUD
- Request for examination of a registered design by the owner is increasing from 420 AUD to 500 AUD.
Trademark Updates
- Filing a statement of grounds and particulars (SGP) in opposition to a mark has a new fee:
- For each of the 4th and further grounds (if any) – 250 AUD
- For each of the 11th and further registered or protected trademarks that the opposed trademark is claimed to be substantially identical with, or deceptively similar to (if any) – 250 AUD.
- Applying for the removal of a trademark for non-use increases from 250 AUD to 350 AUD.
Madrid Fee Decreases Coming to Indonesia
Indonesia Madrid Fee Updates Effective October 12th:
Applications and Subsequent Designations
Will decrease from 125 CHF to 110 CHF
Renewals
Will decrease from 156 CHF to 137 CHF
